These Terms of Service ("Terms") govern your access to and use of the services provided by Smartchainers Private Limited ("we", "us", or "our"), operating under the brand PetCare.AI (a PetON Company), including our website (petcare.ai), mobile applications, AI health companion Rio, and all related services.

1. Acceptance of Terms

By accessing or using PetCare.AI, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services. By creating an account, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement.

These Terms apply to all users of our platform, including pet owners, veterinary professionals who list their services, and visitors who browse our website or use our mobile applications.

2. Service Description

PetCare.AI provides the following services:

• Rio AI Health Companion: An artificial intelligence system that analyses pet symptoms, provides health guidance, and delivers urgency assessments to help you make informed decisions about your pet's care
• Veterinary Directory: A searchable directory of veterinary clinics and professionals, including profiles, fees, availability, and community reviews
• Appointment Booking: An online scheduling system for booking consultations with listed veterinary professionals
• Health Records: Digital storage and management of your pet's health history, vaccination records, and consultation notes
• Community Reviews: A platform for pet owners to share reviews and experiences with veterinary clinics

3. AI Disclaimer

By using Rio, you acknowledge and agree that:

• Rio's responses are AI-generated guidance, not professional veterinary advice
• Rio may not identify all conditions or provide complete information about every health concern
• You are solely responsible for decisions regarding your pet's health and medical care
• PetCare.AI is not liable for any outcomes resulting from reliance on Rio's guidance without professional veterinary consultation
• Rio's urgency classifications (Monitor, See a Vet, Urgent Care) are advisory and not definitive

4. User Accounts and Responsibilities

4.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately at contact@smartchainers.com if you suspect unauthorised access to your account.

4.3 Accuracy of Pet Information

You are responsible for ensuring that the pet information you provide (species, breed, age, weight, symptoms, and medical history) is accurate. Inaccurate information may result in less reliable AI guidance.

5. Acceptable Use Policy

You agree not to use PetCare.AI to:

• Submit false, misleading, or fraudulent information
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the platform's infrastructure, security, or other users' experience
• Attempt to gain unauthorised access to any part of the service, other accounts, or computer systems
• Use automated tools (bots, scrapers, crawlers) to access the service without our written permission
• Upload content that is harmful, offensive, defamatory, or infringes on intellectual property rights
• Use the service for any unlawful purpose or in violation of any applicable laws
• Submit deliberately misleading symptoms or information to manipulate AI responses
• Post fake or malicious reviews of veterinary professionals

6. Vet Listing Disclaimer

PetCare.AI's veterinary directory contains information about veterinary clinics and professionals. Regarding these listings:

• Information Accuracy: While we strive to maintain accurate listings, we do not independently verify all information provided by veterinary professionals. Clinic details, fees, operating hours, and qualifications are provided by the listed professionals or sourced from community contributions
• Community Contributions: Some listing information is contributed by the community. We encourage accuracy but cannot guarantee the completeness or correctness of community-contributed data
• No Endorsement: Listing a veterinary professional on our platform does not constitute an endorsement, recommendation, or guarantee of the quality of their services
• Reviews: User reviews represent individual experiences and opinions. PetCare.AI does not verify the accuracy of reviews but reserves the right to remove reviews that violate our guidelines
• Your Due Diligence: You are responsible for verifying the credentials, qualifications, and suitability of any veterinary professional before engaging their services

7. Appointment Booking Terms

When booking appointments through PetCare.AI:

• Appointments are subject to the availability and acceptance of the veterinary professional
• PetCare.AI facilitates the booking process but is not a party to the agreement between you and the veterinary professional
• Cancellation and rescheduling policies are set by individual veterinary clinics; please review their policies before booking
• Payment terms, consultation fees, and refund policies are determined by the veterinary professional
• You agree to arrive on time and provide accurate information about your pet's condition
• PetCare.AI is not liable for the quality, outcome, or conduct of any consultation booked through our platform

8. Intellectual Property

All content, features, and functionality of PetCare.AI — including but not limited to text, graphics, logos, icons, images, software, AI models, and the overall design — are owned by Smartchainers Private Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws.

• The PetCare.AI name, logo, Rio name, and PetON brand are trademarks of Smartchainers Private Limited
• You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent
• Content you submit (reviews, pet photos, health queries) remains yours, but you grant us a non-exclusive, royalty-free licence to use it for operating and improving our services
• AI-generated content (Rio's responses) is provided for your personal use and may not be commercially redistributed

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• PetCare.AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
• We are not liable for any harm, injury, or loss to any pet resulting from reliance on AI-generated guidance without professional veterinary consultation
• Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim, or INR 10,000, whichever is greater
• We do not guarantee that the service will be uninterrupted, error-free, or completely secure
• We are not responsible for the actions, services, or content of third-party veterinary professionals listed on our platform

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Smartchainers Private Limited, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of PetCare.AI or violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit to the platform, including reviews and pet information
• Your interactions with veterinary professionals facilitated through our platform

11. Termination

We may suspend or terminate your account and access to our services at our discretion, without prior notice, if:

• You breach these Terms or any applicable laws
• Your conduct poses a risk to the safety, security, or integrity of our platform or other users
• Your account has been inactive for an extended period (we will notify you before such termination)
• We are required to do so by law

You may terminate your account at any time by contacting us at contact@smartchainers.com. Upon termination, your right to use the service ceases immediately. We may retain certain data as described in our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or your use of PetCare.AI shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Notify registered users via email
• Display a notice within our applications

Your continued use of PetCare.AI after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
